Does the case continue on with Judge Jack@$$? He clearly revealed his bias when he made his idotic ruling that has been successfully appealed. He may be in an even worse mood having been shown to be a fool.

It is unlikely Warman will appeal.

This ruling is a huge victory for freedom in Canada. The three judges completely understood the issues and couldn't have ruled better.

Great news, and a win is a win, but does this mean it starts over with a new judge?


Conclusion
. . .

[46] Accordingly, the appeal is allowed and the matter is remitted to a different motions judge for re-consideration based on the principles set out above.

Costs
[47] The intervenors do not seek costs in respect of this appeal. The appellants are entitled to costs on a partial indemnity basis payable by the Respondent in the amount of $10,000 on an all, inclusive basis in respect of the motion, leave to appeal 'and the bearing of the appeal.

I am looking forward to reading about all the legal, political, and public implications and reactions to this decision. Hopefully those that understand the impact of this ruling will start a new thread with that in mind. Thanks

The motions judge who heard the original motion is not the judge who will be hearing the underlying defamation case, Angleland.

The case will now proceed as expected, pirapoi. There will be many steps along the way but this was the big one. This appeal and the freedom issues that surrounded it was much more important than whether or not Richard Warman was defamed. This appeal was what we had to win for Canada.

This is a victory for all Canadians and many thanks are in order, from our excellent lawyer Barbara Kulaszka to the many people who have given us the moral and financial support that made it all happen.

The media is sure to report it, styky. This appeal ruling has far-reaching and very beneficial ramifications. We will be issuing a press release shortly.
